Apple Takes on U.S. International Trade Commission in Lobbying Effort

In a bold move to defend itself against patent complaints and potential import bans, tech giant Apple is ramping up its lobbying efforts in Washington. The company is pushing for legislative changes that would reshape the rules of the U.S. International Trade Commission (I.T.C.), a federal agency that has been a thorn in Apple’s side for years.

The I.T.C.’s patent judges have previously found Apple guilty of infringing on innovations in smartphones, semiconductors, and smartwatches. Most recently, the agency forced Apple to remove a health feature from its Apple Watches after a complaint from medical device makers AliveCor and Masimo.

Now, Apple is fighting back. The company is lobbying lawmakers to make some patent owners ineligible to bring complaints before the I.T.C. It is also seeking to influence the agency’s rules on punishments and public interest considerations.

The lobbying effort comes as Apple is embroiled in a legal battle with AliveCor and Masimo over technology in the Apple Watch. Despite losing cases and removing infringing features, Apple is appealing the I.T.C.’s decisions and advocating for changes to the agency’s practices.

One key issue for Apple is the I.T.C.’s power to ban imports of products that violate patents. As Apple manufactures its devices overseas, an import ban could have severe consequences for the company. Apple argues that the agency should prioritize the public interest in its decisions and consider the harm that import bans could cause to American consumers.

However, some experts, like patent law professor Adam Mossoff, argue that Apple’s lobbying efforts are misguided. The I.T.C. is designed to protect American innovation by enforcing patent rights, and import bans are a legitimate form of punishment for patent infringement.

Despite facing challenges from the I.T.C. in the past, Apple has largely avoided import bans through legal maneuvers and settlements. But as regulatory challenges mount, the company has expanded its lobbying efforts in Washington, working with industry allies and lawmakers to push for changes to the I.T.C.’s practices.

Apple’s lobbying campaign has not been without controversy, with some lawmakers raising concerns about the company’s tactics. However, Apple maintains that its lobbying efforts are transparent and focused on protecting its products and customers.

As the battle between Apple and the I.T.C. continues, the tech giant is making a bold stand to reshape the rules of the game and protect its interests in the face of regulatory challenges.
