The US Olympic and Paralympic Committee has taken legal action against Logan Paul and KSI’s Prime energy drinks brand, alleging trademark infringement. The committee claims that Prime has used trademarked Olympic phrases and symbols on a special edition of its hydration drink featuring basketball star Kevin Durant, without permission.
According to the lawsuit filed in Colorado, Prime has also allegedly used the trademarks in internet campaigns and promotions, potentially misleading consumers into thinking there is a partnership between Prime and the US Olympic and Paralympic Committee. Despite receiving a cease and desist letter, Prime continued to market the product with the branding.
Criticism has been directed at Prime for targeting a younger audience, with some schools in the UK issuing warnings or banning the drink. The company’s energy drink contains caffeine, but it also offers a caffeine-free hydration drink. US Senate Majority Leader Chuck Schumer recently called for an investigation into Prime due to the high caffeine content of its energy drink.
In response, Prime has stated that it complies with regulatory requirements in the countries it operates in. The brand, founded by Logan Paul and KSI, has a massive following on YouTube and has collaborated with top sporting stars and teams like Arsenal and the LA Dodgers.
Prime’s release in the UK in 2022 generated significant hype, leading some shops to limit the number of bottles sold per customer. The BBC has reached out to Prime for comment on the lawsuit.
